China Mobile Hong Kong Limited Number Verification Service Agreement
Before using this service, please read carefully and ensure that you fully understand, agree and accept the entire contents of this Agreement, especially the contents marked in bold. If you do not agree with this Agreement and any modifications or additions thereto made by CMHK from time to time, you should stop using the Service immediately. If you confirm the use of the Service, you shall be deemed to have read and agreed to the entire contents of this Agreement and accepted any modifications and additions to the terms of this Agreement from time to time made by CMHK unilaterally, and this Agreement shall be legally effective between you and CMHK and shall become a binding legal document for both parties. By clicking on the ‘Agree’ and ‘Accept’ buttons or options, you are deemed to have read and agreed to the entire contents of this Agreement, and this Agreement constitutes a binding legal document for both parties.

I. Scope of the Agreement and Modification Statement
1.1 Scope of Application
This is an agreement between you (or the ‘User’) and CMHK regarding the use of the Service.
1.2 Relationship
The contents of this Agreement, including but not limited to the Service, new agreements, rules and regulations related to the Service, and CMHK's agreements, rules and regulations related to the Service that may be issued from time to time, shall be an integral part of this Agreement and shall constitute a unified whole with the aforementioned contents once they are officially issued.
1.3 Protocol modifications
CMHK reserves the right to modify the TOS and the relevant terms and conditions of each individual service by giving reasonable notice to the users when necessary (including but not limited to changes in laws and regulations and technical updates, etc.). When enjoying the Services, you should promptly review and understand the contents of the modifications and consciously comply with the modified Terms of Service and the relevant terms and conditions of each individual service. If you continue to use the Services, you are deemed to have agreed to the modified content; if you do not agree to the modified content, you have the right to stop using the Services.
II. Service Use, Change and Discontinuation
2.1 Service content
The content of this service refers to the service provided by CMHK for users to log in to Internet applications based on their mobile phone numbers (‘the Service’). The specific content of the Service is as follows: i.e. through the network authentication capability of Mobile Authentication, it realises the ability of Internet application users to automatically log in using their local mobile phone numbers without entering account passwords. Number verification is the optimisation of the existing SMS verification mode, using the network layer number authentication capability which cannot be intercepted by the application layer to verify the authenticity of the number; it can eliminate the shortcomings of the existing SMS verification mode in terms of long waiting time, cumbersome operation and easy leakage.
2.2 Forms of service
You may use the Service through third party Internet applications.
Note: You can only use this service when you are using CMHK data. The Service verifies
the account with the CMHK SIM card number of your mobile data usage.
2.3 Use of services
Before using the Service, you should read and agree to the terms of this Agreement before completing the registration/login operation as prompted on the page. If you do not agree to this Agreement, please stop using the Service. By triggering the registration/login process or clicking on the ‘Agree’ or ‘Accept’ buttons or options, you signify that you have entered into an agreement with CMHK and that you fully understand, acknowledge and agree to the entire contents of this Agreement. CMHK grants you a personal, non-transferable and non-exclusive licence to use the Service. All other rights not expressly granted herein are reserved by CMHK and your use of such rights requires the express written permission of CMHK.
2.4 Change and Termination of Services
The User or CMHK may terminate the Service at any time based on the actual situation.The Service will be automatically terminated if the User ceases to use CMHK's data. Upon termination of the Service, the User shall contact the third party internet application to resolve the login problem. CMHK has the right to unilaterally terminate the provision of one or more services to you without notice; you also have the right to unilaterally terminate the acceptance of Mobile Authentication services without notice. Upon termination of the User Services, your right to use the Services immediately terminates, and CMHK shall not be liable to you for any obligations in respect of the Services. You understand and agree that any change or termination of the Service is a business decision of CMHK. You shall not require CMHK to continue to provide the Service or assume any form of liability due to any change or termination of the Service.
III、User rights
The User undertakes that the use of the Network Service shall be in accordance with the laws of the Hong Kong Special Administrative Region and that his/her behaviour shall comply with the following requirements. If the User violates any of the following requirements, CMHK has the right to directly take all necessary measures, including but not limited to restricting or suspending the User's use of the Service without any notice:
(1) Users shall not use the CMHK Authentication Service for malicious purposes by any means, including but not limited to registering more than one account for the purpose of profit-making, speculation, etc. Users shall not steal the accounts of other users. Users shall also not steal other users' accounts.
(2) Users shall not engage in or allow any conduct or content that is unlawful, inappropriate, obscene, lewd, immoral, defamatory, fraudulent or dishonest in use, misleading, discriminatory, incitement to hatred, incitement to rebellion, secession, endangerment of public order or endangerment of national security;
(3) Users shall not engage in unlawful or improper behaviour, or send vulgar or obscene text messages or use abusive language to other customers or employees of CMHK through the Services;
(4) Users shall not engage in or permit hacking activities, attacks, interference or unauthorised access to, use of or access to any other third party devices, equipment, facilities, systems, websites, web pages, information or content;
(5) The User shall not involve or allow any storage, use, uploading or downloading of any tools or software for the purpose of collecting any address or IP address, any personal data, or any unauthorised information;
(6) The User shall not receive, transcribe, publish, distribute or dispense with, transmit or circulate, or make use of any illegal or unauthorised content;
(7) Users shall not receive, copy, publish, distribute or dispense with, transmit or circulate, or make any use of commercial content or for commercial or pyramid selling purposes;
(8) Users shall not involve or allow damage to or interference with the normal operation of the service;
(9) Users shall not engage in or permit any conduct that may materially affect the normal operation of all or part of the Services.
IV、Intellectual Property Rights (IPR)
All intellectual property rights related to this service belong to CMHK and are protected by relevant laws, and the use of this service does not involve any transfer or licence of intellectual property rights. The function variable names, trademarks, texts, video and sound contents, graphics and images contained in the CMHK Certification are protected by relevant trademark laws, copyright laws and other intellectual property laws, and may not be reproduced or transmitted in any form by any enterprise or individual without the prior written consent of CMHK.
V、Refusal of Warranty and Disclaimer
5.1 CMHK makes no representations or warranties of any kind (express or implied) as to the provision of the Service (including, without limitation, the suitability of the Service for any purpose, the standard of quality or performance, the accuracy, the merchantability, the fitness for a particular purpose and the non-infringement of the rights of others). CMHK hereby expressly disclaims any warranty that the Services will be uninterrupted, error-free or free from any contaminating or destructive properties.
5.2 CMHK shall not be liable for the availability, quality, nature, accuracy and usefulness of the Service or any related materials, content and functions.
5.3 CMHK does not warrant that:
(a) The Service meets the User's requirements;
(b) The Service will be uninterrupted, timely, secure or error-free;
(c) the information obtained from the use of the Service is correct or true;
(d) any services, information or other materials obtained by the User through the Service will meet the User's expectations.
5.4 CMHK shall not be liable for the timeliness, deletion, mis-delivery, non-storage of any User's communication or personalisation, or for the loss and non-recovery of data in the User's mobile communication device as a result of the download of any data.
5.5 The User agrees that CMHK shall not be liable for any consequences, costs, expenses, losses or damages that may be incurred or suffered by the User as a result of the User's use of any of the functions or contents of the Service and the Service, either potentially or materially.
5.6 In no event shall CMHK be liable in contract, tort (including negligence or breach of statutory duty) or otherwise for any loss of revenue (whether direct or indirect), loss of profits or any consequential loss in connection with the Service.
5.7 CMHK shall in no event be liable to the User for any indirect, incidental, consequential, reliance or special damages or loss of revenue, loss of data, loss of savings or loss of profits of any kind, regardless of the form of action, whether in contract, warranty, strict liability or in tort, including, without limitation, negligence of any kind, whether active or passive.
5.8 Without prejudice to the generality of the foregoing and to the fullest extent permitted by law, the entire amount of CMHK's liability under the Service, including claims, costs, damages, etc. in connection with the Service shall not exceed the total amount of service fees paid by the Subscriber in the 24 months prior to the date of occurrence of any claim.
5.9 In order to use the Service, you must go through a third party that provides you with network access services (mainly including the Internet, WAP network and mobile phone communication) and pay for the network communication costs that may be incurred by yourself. In addition, you must equip yourself with and be responsible for all necessary equipment, such as computers, mobile phones and other devices, required for connecting to the networks. You understand and agree that you will not hold CMHK liable for any form of legal responsibility for network communication costs and equipment usage costs.
5.10 CMHK has no control over and does not guarantee the quality, safety and legality of the services and/or products provided by any third party Internet application, nor the goodwill and trustworthiness of any third party Internet application. Any enquiry, claim or complaint regarding the quality or availability of the services and/or tickets provided by the third party Internet application should be directed to the relevant Internet application. CMHK accepts no responsibility in this regard.
5.11 To the fullest extent permitted by law, CMHK shall not be liable for any consequences, costs, expenses, losses or damages that may be incurred or suffered as a result of or arising out of any of the functions or contents of the services and/or products supplied by the third party Internet Application and the use of the services and/or products supplied by the third party.
5.12 CMHK does not make any representation, warranty or accept any responsibility for any of the information, content and functionality of the services and/or products of the Third Party Internet Application Provider, including, without limitation, fitness for a particular purpose, availability, quality, nature, accuracy and usefulness, or the legitimacy of the intellectual property rights that may be contained therein.
VI. Others
6.1 CMHK reserves the right to temporarily or permanently suspend the User's access to the Service if CMHK discovers that the User is using the Service in a suspicious or uncertain, fraudulent, deceptive, unlawful or improper manner.
6.2 CMHK may at any time, with or without notice.
(a) cancel or suspend the Service or any part thereof for system maintenance, updating, testing and/or repair;
(b) restrict or suspend the User's use of the Service if, in the opinion of CMHK, the User is using the Service inappropriately;
(c) CMHK believes, for different reasons, that accessibility of the Service adversely affects the administration or operation of the Service or CMHK's business. CMHK may take any action to expand, reduce, modify, suspend or limit any feature or content of the Service.
6.3 By using the Service, the User agrees and accepts CMHK's collection, use and disclosure of his/her personal data for the administration of the Campaign and all purposes related to the Service. The User has read, understands and agrees to be bound by the contents of CMHK's General Personal Information Collection Statement and Privacy Policy Statement. 6.4 The above statements are issued in compliance with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486) (‘PDPO’) to notify the users of the purpose of data collection and the users' consent to the use of such data and their rights by CMHK. Users have the right to request access to or correction of their personal data in accordance with the provisions of the Personal Data (Privacy) Ordinance. Please refer to CMHK's Privacy Policy Statement for details of any data access or correction requests.
6.5 Users may be required to provide personally identifiable information to CMHK. Such information is necessary for the User to be able to use the Service. If the User fails to provide the required information, the User will not be able to use the Service.
6.6 Subscriber's requests for access to personal data and correction of personal data or enquiries regarding statements relating to personal data should be addressed to: CMHK, 20/F, Tower 1, Kowloon Trade Centre, 51 Kwai Cheong Road, Kwai Chung, New Territories, Hong Kong, Attn: Data Protection Officer; or CMHK's Do-Not-Call Commercial Electronic Messages Registration Hotline at 6226 4926 or Subscriber's Service Hotline at 12580.
6.7 CMHK reserves the right to vary or amend these Terms and Conditions and any related terms and conditions at any time without prior notice. CMHK will list such changes on CMHK's website. The User's continued use of the Service shall constitute the User's acceptance of any changes or amendments to these Terms and Conditions and any related terms and conditions.
6.8 The content, type of content and charges of the Service are subject to change by CMHK from time to time without prior notice.
In any event, if any provision of these Terms and Conditions (in whole or in part) is or is found or deemed invalid, unlawful or unenforceable for any reason whatsoever, it will not affect the validity, legality and enforceability of the remaining provisions.
6.9 In case of any dispute, CMHK reserves all rights of final and absolute decision.
6.10 In the event of any discrepancy between the English and Chinese versions of these Terms and Conditions, the Chinese version shall prevail.
6.11 These Terms and Conditions are governed by the laws of Hong Kong. Any litigation arising out of these Terms and Conditions shall be subject to the exclusive jurisdiction of Hong Kong.
6.12 Neither the User nor CMHK shall be entitled to exercise any of the provisions of these Terms and Conditions under the Contracts (Rights of Third Parties) Ordinance (Chapter 623 of the Laws of Hong Kong).
